My paper will research and analyze the ban on the sale of sugary drinks in containers larger than 16 fluid ounces in New York City. The ban was proposed by Mayor Michael Bloomberg in May 2012 and adopted by the NYC Board of Health on September 13, 2012. On October 12, 2012, the American Beverage Association, among other plaintiffs, filed a Declaratory Judgment petition in the Supreme Court of New York County challenging the ban. The paper will address the related public health and legal arguments on both sides of this case.
