An "Analysis of an Issue of Contention between the County Board and the Board of Health with Suggestions for Resolution" is an analysis and review of the historical background, formation and fiduciary responsibilities of the two boards in relationship to the board of health's budget and programs and the county board's fiscal oversight responsibility in regards to that budget.A legal framework of understanding is proposed based on a review of the law and legal opinions in this area. A list of suggestions is presented to resolve or reduce this tension.

Learning Objectives:

• To understand the difference between a board of health formed by resolution and by referendum.
• To understand the authority given to boards of health by the sovereign government, the state.
• To be able to analyse tension that exists between the county board and the board of health as it exists in relation to the county board's fiscal oversight of the board of health's budget.
• To review the legal background and case law that concerns itself with resolving issues around this "tension" that exists between the two boards. 5.A pragmatic listing of suggestions to resolve or reduce this tension.
